Hi-Yo, Silver! Away!

sheldonsilver-012215 copyOpenCdA’s post on December 1, 2015, titled Another Conviction for Corruption (Somewhere Else) reported the conviction of former New York State Assembly Speaker Sheldon Silver (D) on federal corruption charges.

Today, May 3, 2016, Preet Bharara (D), the US Attorney for the Southern District of New York announced that Silver was sentenced to 12 years in federal prision by US District Judge Valerie E. Caproni.  US Attorney Bharara’s formal announcement contains a good explanation of the crimes proven against Silver.  It also describes the schemes and mechanisms Silver used to sell his elected position in the New York State Legislature and thereby personally enrich himself.

We had to give Silver’s defense attorneys an “E” for Effort in invoking the unofficial and undocumented Idaho Standard frequently used by prosecutors as an excuse to not charge or to plead down sentences:  “Mr. Silver has demonstrated a capacity to do a tremendous amount of good for the public. His personality, vision, and persistence have been brought to bear with great effect.   It is doubtful this Court will ever sentence a defendant with as rich a record of doing so much for others.”  (see this Washington Post article).

Boy, were Silver’s defense attorneys ever wrong.

Public officials often rely on the advice of either their own or their governing body’s legal counsel, often assuming that reliance somehow makes them immune from the law and the court.  We remind those officials of what Silver learned today:  Every federal prisoner sitting (or soon to be sitting) in a federal prison was represented and advised by legal counsel.

    Thanks for the link. The one in #2 is dead, but #3 links to the searchable database.

    From news accounts it sounds as if the damage assessment part of Clinton’s traitorous behaviors with her email server may nearly be as complete as it can be. To whatever extent the Intelligence Community has been unable to identify information that was successfully removed at Clinton’s direction, there will be holes in assessing how much damage her betrayal of her country’s national security did. It’s a case of potentially more harm being concealed by what the investigators don’t know because she took affirmative and effective steps to conceal it. To compound the damage, the investigators may be unable to completely determine who was able to access the information before Clinton successfully took steps to intentionally have it removed.

  5. I did not mean to post 2 that way. If our government does not hang Hillary Clinton out to dry … well, let’s just say, I don’t think it will be pretty. ‘Irreprehensible’ does not begin to describe the so called professional behavior of this woman, she is worse than a nuclear bomb. Her IT guy received immunity to help with the investigation … and while they may find no “willful intention” …. it certainly does not explain her complete idiocy acting as our Secretary of State, Senator, and now Presidential candidate … not to mention she is a sleazy lawyer along with her good buddy, President Obama. She has one email that is titled, “I am working from home” — is that not enough? There is someone claiming that he hacked her server but the FBI says it is not credible … I think it is all a whitewash and cover-up, sounds like right here at home. Anyone that votes for her is dumber than a box of rocks and cares NOTHING about our national security. All they have to do is read …there is another email where she is supporting programs/funds to be given to Columbia to stop them from manufacturing heroin …wth?? — No wonder they like her!! That is my labor they are giving away in tax dollars … I have never wanted a wall so much until after I read that one. How anyone after this sloppy and reckless management of FEDERAL RECORDS can begin to support this treasonous witch is right in the cauldron with her. Trump is a Teddy Bear compared to her slimy vile flesh. And any Democrat that minimizes her recklessness and complete intentional disregard of the people and most likely intentional criminal behavior is as corrupt as she is and/or is also intentionally stupid, dumb, and stupider.
