Judge Charles W. Hosack has been appointed to hear the lawsuit filed in First District Court by Coeur d’Alene city council candidate Jim Brannon.  Brannon’s lawsuit contests the outcome of the election for Coeur d’Alene City Council Seat #2, an election won by five votes by incumbent candidate Mike Kennedy.

  1. I think we most likely have the best judge in the area. He stays out of the limelight/social fray thus, it would be hard pressd to connect him to anyone. I am curious to see what kind of bond needs to be posted if any.

  2. Stebbijo,

Thanks for commenting. I believe Judge Hosack is scheduled to retire soon.

As noted in Jim Brannon’s complaint filed with the court, there is no particular bond specified for contesting a municipal election. The complaint goes on to say, however, that Brannon filed a $500 bond with the complaint to demonstrate his good faith in proceeding.

  3. So, Bill, are you saying that an additional bond may not be required?

  4. Mary,

Any bond is up to the court. The judge could increase, decrease, or not even require a bond be posted. Jim posted $500 up front in good faith in the absence of any specific requirement.
