Undivided Loyalty
Public policy demands that an officeholder discharge his or her duties with undivided loyalty. When an official is elected by her constituents to a position of public trust and responsibility, those constituents have every right to assume that the official will put the duties of that office ahead of those duties required of any and all other offices the official may hold. Indeed, the official’s constituents have every right to assume the official will voluntarily and even automatically vacate any office whose duties are incompatible with those of a position she already holds. This is the common law doctrine of incompatibility of office. The Idaho Legislature and the City of Coeur d’Alene have chosen to ignore this. (more…)

Plan, Prepare, Practice
The recent mass shooting in Aurora, Colorado, and the one in Tucson, Arizona, in 2011 understandably draw the public’s attention to law enforcement’s preparation for mass shooting events.
But we, the public, sometimes become so consumed by the police preparation that we forget the fire and emergency medical services have an equally important role to play in mitigating the event and saving lives.
In its July 26, 2012, online post, Fire Chief magazine tells the fire service How to Prepare Your Department for Mass Shootings Like in Aurora, Colo.

The Idaho Supreme Court has notified the parties’ attorneys that oral arguments in the 2009 election contest lawsuit appeal (Brannon v. City of Coeur d’Alene, et al) will be heard Wednesday, September 19, 2012, at 11:10 a.m. at the Kootenai County Courthouse.

Another Mayor Under Federal Investigation

Trenton, NJ, Mayor Tony Mack is under investigation by the Federal Bureau of Investigation (FBI).
According to a NJ.com article headlined “FBI probe of Trenton Mayor Tony Mack includes searches of houses of his brother, campaign supporter”,the FBI executed a nighttime search warrant on Mack’s home beginning at about 1 a.m. on Wednesday, July 17. Most search warrants are daytime search warrants (typically “daytime” means between 6 a.m. and 10 p.m.), however nighttime search warrants can be specially authorized if the issuing judge deems it necessary for the safety of law enforcement and the people involved or if there is a reasonable belief that evidence sought may be destroyed if the search were limited to daytime. Dixon v. City of Coeur d’Alene Decision and Order

United States Magistrate Judge Larry M. Boyle has issued his Memorandum Decision and Order in Dixon v. City of Coeur d’Alene. The Judge’s decision reduced the total amount the City must pay from $3,763,541 to $3,238,899. (more…)

Pegging the Hypocrisy Meter
The Coeur d’Alene Press is the propaganda instrument of the Hagadone Corporation, so it is hardly surprising that this Sunday’s editorial titled “Clarify rules for recalls” pegs the hypocrisy meter. Now the Press wants to see Idaho’s recall election laws examined and reformed.
But where was the Press almost three years ago when Jim Brannon began an action to contest the illegal conduct of the 2009 Coeur d’Alene City election? Hiding under the beds with some District Court judges, Secretary of State Ben Ysursa, Kootenai County Clerk Dan English and Kootenai County Prosecutor Barry McHugh who did not want anyone understanding just how FUBAR Idaho’s election administration laws were. Today, those same laws are SUSFU. And that’s exactly the way the aforementioned Press and officials like them. (more…)
